These Terms and Conditions (“Terms”) govern the use of the Observant Solutions website and services, including the purchase of products through our online store and the provision of technical services. By accessing or using our website, requesting a quotation, purchasing a product, or booking a service, you agree to be bound by these Terms.

 

1. Company Information

Observant Solutions (Pty) Ltd (“Observant Solutions”, “we”, “us”, “our”) provides industrial weighing equipment, calibration, verification, maintenance, repair services and related technical support.

 

2. Acceptance of Terms

By using this website or our services you confirm that:

  • You are legally capable of entering into a binding agreement

  • All information provided is accurate

  • You will not misuse the website or services

If you do not agree with these Terms, you must not use our website or services.

 

3. Quotations and Orders

  • All quotations are valid for 14 days unless stated otherwise

  • Prices may change without notice before order confirmation

  • An order is only confirmed once payment is received or a signed acceptance is provided

  • Observant Solutions reserves the right to refuse or cancel any order

4. Product Sales (Online Store)

4.1 Product Information

We strive to ensure all product descriptions, specifications and images are accurate, however minor variations may occur.

 

4.2 Pricing

  • All prices are listed in South African Rand (ZAR)

  • Prices exclude delivery unless specified

  • Typographical pricing errors may be corrected and orders adjusted or cancelled

4.3 Payment

Orders must be paid in full before dispatch unless credit terms have been approved in writing.

Accepted methods: EFT / Online Payment Gateway / Approved Account Holders

 

4.4 Delivery

  • Delivery times are estimates only

  • Risk transfers to the customer upon delivery or collection

  • Customers must inspect goods within 24 hours and report damages

5. Services (Calibration, Verification, Repairs & Maintenance)

5.1 Booking

Service dates are subject to technician availability and confirmation.

 

5.2 Site Readiness

Clients must ensure:

  • Safe working environment

  • Equipment accessibility

  • Power availability

Failure may result in call-out charges.

 

5.3 Findings & Additional Work

If additional faults are discovered, a revised quotation will be issued before further work proceeds.

 

5.4 Compliance

Calibration and verification services are performed according to industry standards. However, compliance approval by regulatory authorities remains the responsibility of the client.

 

6. Returns and Refunds

6.1 Products

Returns accepted within 7 days if:

  • Unused

  • In original packaging

  • Approved by Observant Solutions

Non-returnable items:

  • Special order items

  • Installed equipment

  • Calibrated equipment

6.2 Services

Service fees are non-refundable once work has commenced.

 

7. Warranty

  • New equipment carries manufacturer warranty

  • Repairs carry 30 day workmanship warranty

  • Warranty excludes misuse, overload, tampering, environmental damage or power surges

8. Limitation of Liability

Observant Solutions shall not be liable for:

  • Loss of production

  • Loss of profit

  • Indirect or consequential damages

  • Incorrect use of weighing results by client

Maximum liability limited to amount paid for the specific service or product.

 

9. Intellectual Property

All website content including logos, text, graphics and documents remain the property of Observant Solutions and may not be copied or distributed without permission.

 

10. Account Suspension

We may suspend accounts for:

  • Fraudulent activity

  • Abuse of staff

  • Non-payment

  • Misuse of services

11. Force Majeure

We are not liable for delays caused by events beyond reasonable control including power outages, strikes, transport delays, supplier shortages or natural disasters.

 

12. Governing Law

These Terms are governed by the laws of the Republic of South Africa.

 

13. Changes to Terms

We may update these Terms at any time. Continued use of the website constitutes acceptance of updated Terms.
